McAndrews, Held & Malloy Attorney Authors Amicus Brief for AIPLA In Major Design Patent Case

CHICAGO, IL – May 13, 2010 – McAndrews, Held & Malloy Shareholder Christopher V. Carani authored an amicus brief on behalf of the American Intellectual Property Law Association (AIPLA) in a major Federal Circuit case of first impression concerning claim construction for design patents.
The amicus brief urges en banc rehearing of the March 2010 decision by the U.S. Court of Appeals for the Federal Circuit in Richardson v. Stanley Works, Inc. That decision affirmed that courts should compare only ornamental features of products, and not functional features, when analyzing the products for design patent infringement. The AIPLA amicus brief addresses how functional features should be treated during design patent claim construction.
Carani, who currently chairs the Industrial Designs Committee for AIPLA, also authored amicus briefs for the AIPLA at both the petition and en banc stages in the landmark design patent case Egyptian Goddess, Inc. v. Swisa. Carani is nationally recognized in the field of design law, which is the focus of his practice. He has litigated numerous matters regarding design rights and has served as a consultant and expert witness in design law cases. He also has lectured and published extensively on issues relating to design law.
